Terms & Conditions


The Terms and Conditions described herein constitute a legal agreement (“Agreement” or “TransTrac Terms of Use” or “Terms and Conditions”) between you (if your business is a sole proprietorship) or your business (if you are signing up on behalf of a corporation or other legal entity) (the “Merchant”, “you” or “your”) and TransTrac Technologies Services Private Limited, incorporated under the laws of India (“TransTrac”, “we”, “us”, or “our”). Thank you for selecting the services offered by TransTrac TechnologyServices Private Limited and/or its subsidiaries and affiliates (referred to as “TransTrac”, “we”, “our”, or “us”) to you as described on our website (and/or mobile apps) www.credopay.in through our platform namely CredoPay (“CredoPay Platform”) (“Services”).

Definitions & Interpretations

“Acquiring bank” means any bank or financial institution that processes debit card or credit card payments of the User.

“Affiliate” means any entity which from time to time Controls, is Controlled by or is under common Control with the relevant Party or entity, where “Control” means having the ability (including, without limitation, by means of a majority of voting rights or the right to appoint or remove a majority of the board of directors) to control the management and policies of an entity.

“API” or Application programming interface (API) is a set of subroutine definitions, communication protocols and tools for building software and implies a software code that allows two software programmes to communicate with each other.

”Payee” means any person to whom a payment is made, using the Services, (and the term includes a User who uses the Services to receive payment).

“Payer” means any person who makes a payment, using the Services (and the term includes a User who uses the Services to make payment).

“Payer” means any person who makes a payment, using the Services (and the term includes a User who uses the Services to make payment).

“Payer” means any person who makes a payment, using the Services (and the term includes a User who uses the Services to make payment).

“Person” includes (a) any corporation, company, limited liability company, partnership, Governmental Authority, joint venture, fund, trust, association, syndicate, organization, or other entity or group of persons, whether incorporated or not, and (b) any individual.

“Portal” means the web or mobile application used to carry out above mentioned functions and Services.

“Products” mean any services or products which are purchased/ offered for sale by a User to third parties from time to time, Products shall not include those banned products and services that are listed in Annexure A.

“Service Provider” means a bank, association, facility provider, card issuing institution, acquiring bank, other financial institution, card processor, clearing house networks or any such vendors or service providers, that TransTrac may engage with from time to time to provide the services.

“Transaction” means a payment instruction that results in the successful transfer of monies or settlement (a) from a User to a Payee; or (b) from a Payer to a User.

“Transaction Amount” means the total amount payable/ receivable by a User/Payee. This amount shall include all applicable taxes, charges, interest, delivery costs, commissions and other such incidental charges etc.

“TransTrac“, “We” represent the “Service Provider” and are interchangeable. The wordings have been kept simple for easy understanding of every User of the Portal.

“User” shall mean any Person who/which is registered on the CredoPay Platform for using this CredoPay Platform and/or who/ which subscribes for the Services through this CredoPay Platform. The term “User” shall also cover such personnel of any User who are duly authorized to avail of the Services on behalf of the User.


Clause headings are for ease of reference only and are not intended to be part of or to affect the meaning, interpretation, or construction of any of the terms and conditions of this Agreement.

References to any gender includes any other gender, the plural shall include the singular and bodies corporate shall include unincorporated bodies and (in each case) vice versa.

Reference to any statute, enactment, ordinance, order, regulation or other similar instrument shall be construed to include a reference to the statute, enactment, ordinance, order, regulation or instrument as from time to time amended, extended, re-enacted or consolidated; and all statutory instruments, orders, regulations or instruments made pursuant to it.

Clauses, sections, pages, and schedules referenced by name shall refer to the clause, section, page, or schedule having the title referred to.


In order to avail the Services, User must be registered with CredoPay Platform and / or TransTrac. User shall provide TransTrac with all such identification and address proof documents as may be required by TransTrac. By registering with TransTrac or on CredoPay Platform, User agrees to provide true, accurate, current and complete information, failing which TransTrac may at any time reject User’s registration and terminate his right to use or access the CredoPayPlatform and/or Services. When User registers on the CredoPay Platform, a User Account will be created, that is associated with User’s username, password and other identifying information. User shall be responsible for anything that happens through his User Account. User also expressly covenants that the User Account shall be used by him only for his valid and genuine business transactions and not otherwise or for any activity prohibited in Annexure “A” or for scrupulous/fake transactions.

By registering with CredoPay Platform, User expressly consents to the terms and conditions, payment terms and Privacy Policy. If the User do not feel comfortable with any part of our Terms of Service, he must not use or access the Service. The User expressly undertakes to keep his account information, which includes but not limited to his primary email address, contact number, credit card number, bank account number, communication address, ownership or legal status current and valid and in case of any change in information provided, update his account immediately.


CredoPay Platform is licensed on a periodic subscription basis, as selected by you or your organization.A User is required to subscribe to any of the available plans to be able to utilize the Services. The Subscription Fees shall be payable by User as per the subscription plan chosen by him.

A User shall not be entitled to any refunds or credits in respect of the Subscription Fees/ other fees or payments paid by him, even in cases where the User has elected to terminate his subscription to the Services or cancel his account prior to the end of the period of his subscription.

TransTrac may, from time to time, make changes in the subscription plans, subscription fees, the prices of any Services or TransTrac may charge Users for use of Services that are currently available free of charge. Any such changes made by TransTrac will be applicable as per TransTrac’s notification or communication to the User.

Personal Information

The User will be required to submit the following information while registering: Valid Identification and address proof; Permanent Account Number Card; Business document in case of an entity; and any other information as may be required by TransTrac.

The User authorizes TransTrac directly or through third parties, to make any inquiries as TransTrac may consider necessary to validate the identity, as may be necessary to comply with the obligations under applicable laws and regulations. This may include asking the User for further information or documentation, requiring him to provide personal identification documents, valid identity proof and address proof.

User account, password and security: You are responsible for maintaining the confidentiality of the UserID and password you choose when you create your account and are fully responsible for all activities that occur under your account. You agree to immediately notify TransTracof any unauthorized use of your password. TransTracwill not be liable for any consequence arising from your failure to comply with this section.

Content And Abuse Of Service

You are responsible for all materials (“Content“) uploaded, posted or stored through your use of the Services. You grant TransTraca worldwide, royalty-free, non-exclusive license to host and use any Content provided to offer you the Services. TransTracis not responsible for the Content or data you submit through the Services. You agree not to use, nor permit any third party to use, the Services to upload, post, distribute, link to, publish, reproduce, engage in or transmit any of the following, including but not limited to Illegal, fraudulent, defamatory, obscene, pornographic, irreverent, threatening, abusive, hateful, harassing, offensive, inappropriate or objectionable information or communications of any kind, including without limitation conduct that would encourage “flaming“ others, or criminal or civil liability under any law;

The Services may include community forums or other social features to exchange Content and information with other users of the Services and the public. TransTracdoes not support and is not responsible for the content in these community forums. Please use respect when you interact with other users. Do not reveal information that you do not want to make public. Users may post hypertext links to content of third parties for which TransTracis not responsible.

TransTracmay, but has no obligation to, monitor content on the Services. We may disclose any information necessary to satisfy our legal obligations, protect TransTracor its customers, or operate the Services properly. TransTrac, in its sole discretion, may refuse to post, remove, or refuse to remove, any Content, in whole or in part, alleged to be unacceptable, undesirable, inappropriate, or in violation of this Agreement.

TransTracmay freely use feedback you provide. You agree that TransTracmay use your feedback, suggestions, or ideas in any way, including in future modifications of the Services, other products or services, advertising or marketing materials. You grant TransTraca perpetual, worldwide, fully transferable, sub-licensable, non-revocable, fully paid-up, royalty free license to use the feedback you provide to TransTracin any manner.

Use With Mobile Devices

Use of these Services may be available through a compatible mobile device using Internet access and may require application. You agree that you are solely responsible for these requirements, including any applicable changes, updates and fees for SMS messages, data plans, and general usage, as well as the terms of your agreement with your mobile device and telecommunications provider. TransTracmakes no warranties or representations of any kind, express, statutory or implied as to:

  • The availability of telecommunication services from your provider and access to the services at any time or from any location;
  • Any loss, damage, or other security intrusion of the telecommunication services
  • Any disclosure of information to third parties or failure to transmit any data, communications or settings connected with the services.


The contents of TransTrac’s Services do not constitute advice and should not be relied upon in making or refraining from making, any decision.

Use of Services

The Services may be used exclusively by the User for making and receiving payments from and/or to Payer/Payee or making settlement of a valid and legal transaction.

TransTrac has no obligation to verify the authenticity of the Transaction once the transaction is generated through a valid login and authenticated through a password. The User shall at all times take all appropriate steps, including those as mentioned herein, to maintain the security and confidentiality of the information. TransTrac shall not be liable for any mistake or misuse of the Services by either the User or by any person authorized by the User, or by any person gaining access to the Services through the User. User agrees that TransTrac accepts all instructions originating from his account in good faith and considers that they are genuine and are normal business transaction and, are conducted in a manner, consistent with commercially reasonable security standards. User shall indemnify and hold TransTrac safe and harmless for direct or indirect losses resulted as a result of the disclosure of sensitive information by or through User or for any loss or damage caused to TransTrac, its officers and employees or the acquiring bank for any breach of the Terms of Use or Privacy Policy or any other terms as agreed by the User or his customer or vendor, or for any Intellectual Property infringement claim brought by third party or for any other loss or damage due to security breach.

Change of Terms and Conditions

TransTrac reserves the right to change or modify the Terms and Conditions in this document or any information appearing on or in connection with TransTrac’s Services or CredoPay Platform at any time without notice to the User. TransTrac may at any time revise the terms of use of the Services or CredoPay Platform by updating this document. The User is bound by such revisions and should therefore visit these pages to review the current Terms and Conditions from time to time. By continuing to access the CredoPay Platform or use the Services, the User agrees to have read, understood and be bound by the revised terms.

Link to other party websites

TransTrac’sServices may include links to third party websites including nearby vendors that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites and links and service provided by such vendors. Moreover, you acknowledge and agree that TransTrac shall not have any liability and shall not make responsible for any transaction/conduct/breach between you and any third party or nearby vendors listed on the portal. TransTracshall not be responsible for any breach of conduct and service by nearby vendors.

User Obligations

  • Every User is responsible to (i) furnish correct and accurate information of the Payer/ Payee as may be required, on an independent basis; (ii) furnish to TransTrac forthwith on demand, the original copy/copies of proof of delivery of products/services, invoices or other records pertaining to any Transaction; (iii) ensure that all licenses and registrations required by him are in full force and effect to enable them to carry on the business of sale/ purchase of products and rendering of services and agrees to furnish immediately copies of such licenses on request by TransTrac.
  • User shall not (i) carry out any activity, which is banned, illegal or immoral, (ii) use the Services in any manner or in furtherance of any activity, which constitutes a violation of any law or regulation or which may cause TransTrac to be subject to investigation, prosecution or legal action.
  • User undertakes and assures to TransTrac that payments shall not be made/ received in respect of any products / services mentioned in the banned items list set out in Annexure A hereto and that payments are been made in under valid business contract with the customer or vendor and the payments are in respect of genuine business transaction
  • User undertakes to inform TransTrac if he has any dealing or engages as a vendor/supplier/customer/dealer in any of such prohibited goods at any point of time
  • User shall act in compliance with all laws, rules and regulations and shall at all times comply with the guidelines set by Visa/Master Card/ acquiring banks/ Service Providers, as may be applicable from time to time
  • User shall not sell, provide, exchange, or otherwise disclose to third parties or use themselves (other than for the purpose of completing a Transaction, or as specifically required by law) any personal information about any third party, including the account details and mobile number, without obtaining the prior written consent of such third party.
  • User shall take all precautions as may be feasible or as may be directed by TransTrac to ensure that there is no breach of security and that the integrity of the link between their systems/ site, the CredoPay Platform and the payment mechanism is maintained at all times. In the event of any loss being caused as a result of the link being breached or as a consequence of the link being improper or being in violation of the provisions of this clause, the loss shall be to the account of the User and the User shall indemnify and keep indemnified TransTrac and the Service Providers from any loss as may be caused in this regard.
  • User shall bear and be solely and exclusively responsible for the payment of all relevant & applicable taxes (including any applicable withholding taxes) as may be due from time to time.
  • User shall not at any time require any other user or any other person to provide him with any details of the accounts held by the other users with any Banks including, the passwords, account number, card numbers, mobile phone numbers and PIN which may be assigned to them by the Banks from time to time.
  • User shall use the information regarding a Payee/ Payer (including name, address, e-mail address, telephone numbers and other data) conveyed to him whilst using the Services, only for the purpose of completing the Transaction for which it was furnished, and not to sell or otherwise furnish such information to others unless he has an independent source of such information or obtains the express written consent of such Payee/ Payer.
  • User shall inform TransTrac of any change in his email address, mobile number, address, ownership or legal status or his cessation of business in writing forthwith on such change.
  • User shall not interfere with or damage the CredoPay Platform, including, without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, backdoors, packet or IP spoofing, forged routing or electronic mail address information or similar methods or technology.
  • As a condition of use of the Services, the User will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, or violate the T&Cs. TransTrac reserves the right to suspend User’s TransTrac account or restrict use of services or any such other action as TransTrac may deem fit [ including but not restricted to such legal recourses as may be available], without any prior notice to the User.
  • User shall not impersonate any person or entity, falsely claim or otherwise misrepresent his affiliation with any person or entity, or access the accounts of others without permission, forge another person’s digital signature, misrepresent the source, identity, or content of information transmitted, perform any other similar fraudulent;
  • User shall not infringe TransTrac’s or any third party’s intellectual property rights, rights of publicity or privacy.
  • User shall not use the TransTrac Services or the CredoPay Platform in any manner that could damage, disable, overburden, or impair it, including, without limitation, using the TransTrac Services or the CredoPay Platform in an automated manner or otherwise.
  • TransTrac has the right to investigate and prosecute violation of any of the above to the fullest extent of the law or seek such legal recourse as available[including but not limited to indemnify and keep TransTrac and its officers, affiliates from any such losses or damages as TransTrac may incur on account of such violations and also right to adjust any money lying in the settlement account towards losses or damages that TransTrac may suffer on account of such violation, without prior notice to the User].
  • User shall not use TransTrac Services or CredoPay Platform for any self-financing activities which includes but not limited to transfer of funds to the Payee against any fake or fraudulent transactions, use of credit card registered in User’s name by any other User/Payer on CredoPay Platform, transfer of funds to any subsidiary, holding, associate company of the User or any related party, unless such transfer of funds is towards a genuine transaction between the User and the other Party.
  • TransTrac has the right to temporary terminate such User’s access to the CredoPayPlatform. User shall be given a reasonable opportunity of being heard and provide evidence/proof ensuring the validity of the transaction, any failure to prove the validity of the transaction will lead to permanent embargo on the User to access the CredoPay Platform. In addition to this, TransTrac also has the right to impose penalty or appropriate funds in the user account as it deems fit.

Proprietary Rights

CredoPayPlatform content and the trademarks, service marks and logos contained therein (“Marks“) are owned by or licensed to TransTrac, subject to copyright and other intellectual property rights under the applicable law. Such CredoPay Platform content may not be copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, uploaded, or otherwise exploited without the prior written consent of TransTrac.

The user also expressly agrees and undertakes and consents to use of its trade mark, service mark and logo on TransTrac website/platform/app

Except as expressly authorized by TransTrac, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service, in whole or in part. You also agree not to extract the code or reverse-engineer it in anyway. Any attempt at hacking or unlawful use of CredoPay will invite the prosecution allowable under the law.


TransTractakes every precaution to protect Users' information. When Users submit sensitive information on the portal, the information is protected both online and off-line. We have enabled SSL encryption to ensure that your data remains encrypted during transmission to and from the site. These precautions, though industry standard are nonetheless only as secure as the end-user's practice. To ensure that unauthorized parties do not get access to information on this portal, we encourage all users make sure that they log-off from all sessions - especially from public computers such as at internet cafes.

As part of our disaster recovery strategy, we have regular backups taken to protect you from sudden data loss. If you have any questions about the security at our portal, you can send an email to info@transtrac.in.

Websites and Service Updates

We also send the User website and service announcement updates. Users may choose to unsubscribe from receiving these emails by following the instructions that will be part of each announcement email.

Beta Features

From time to time, TransTracmay, at its sole discretion, include new and/or updated beta features (“Beta Features“) in TransTrac Services for your use and which permit you to provide feedback. You understand and agree that your use of the Beta Features is voluntary and TransTracis not obligated to provide you with any Beta Features. You understand that once you use the Beta Features, you may be unable to revert to the earlier non-beta version of the same or similar feature. Additionally, if such reversion is possible, you may not be able to return or restore data created within the Beta Feature back to the earlier non-beta version. The Beta Features are provided on an “as is“ basis and may contain errors or inaccuracies that could cause failures, corruption or loss of data and/or information from any connected device. You acknowledge and agree that all use of the Beta Features is at your sole risk.

Additional Terms

You will manage your passwords and accept updates. You are responsible for securely managing your password(s) for the Services and to contact TransTrac if you become aware of any unauthorized access to your account. The Services may periodically be updated with tools, utilities, improvements, third party applications, or general updates to improve the Services. You agree to receive these updates.

TransTrac and or the Acquiring Bank will not be responsible for any disputes between the Users and the Payers/ Payees, including issues regarding prices, delivery, non-delivery, deficiency of services or delay in delivery of the Products, quality of Products or services or otherwise. All such disputes will be dealt with by and between the User and the Payer/ Payee directly, and TransTrac shall not be a party to such disputes.

TransTrac cannot and does not guarantee the timings of any payments made or received as such timing is dependent upon User’s or the Payer’s bank, card issuing bank/ card processor (where a credit/ debit card is used), acquiring financial institution and other Service Providers. TransTrac assumes no liability and shall not be held responsible for any delays in delivery of payment or availability of funds when using the Services.

TransTrac and the Acquiring Bank shall not be a party to the contract between the User and any Payer/ Payee in any manner whatsoever. All contracts are directly between Users and their Payers/ Payees.

User shall be responsible for any miscommunication or incorrect User/ third party/ other information that may be provided to TransTrac at the time of enabling the Services for the User.

TransTrac/ Service Provider reserve the right to impose limits on the number of Transactions which may be charged on an individual credit card or other account during any time period and reserve the right to refuse to make payments in respect of Transactions exceeding such limit.

TransTrac/ Service Provider also reserve the right to refuse to make payments in respect of Transactions by Users with a prior history of questionable charges or for any other reason as the case may be.

User will not hold TransTrac liable in case of any improper/ fraudulent/unauthorized/ duplicate/erroneous use of his mobile and/or the web-based access or through any other platform. TransTrac will also not be liable for any direct or indirect consequences connected with the use/ misuse of User’s web/ mobile/ e mail account by any third party. If any third parties gain access to the Services, the User will be responsible and shall indemnify TransTrac against any liability, costs or damages arising out of such misuse / use by third parties based upon or relating to such access and use, or otherwise.

User shall be fully liable for: (a) any unauthorized use of his mobile/ email account; and/or (b) all authorized Transactions on his web/mobile/email account. Without prejudice to the remedies available to TransTrac and these Terms, TransTrac shall be under no liability whatsoever to the User in respect of any loss or damage arising directly or indirectly out of:

  • any defect in any Products supplied to him or services rendered to him;
  • any inability of a third party to supply or deliver the required Products or services in the necessary numbers or types or manner;
  • the refusal of any person (including a Service Provider) to honour or accept a payment;
  • the malfunction of any computer terminal or equipment;
  • the utilization of the Services by any person other than by the User;
  • any transaction which is unsuccessful or fails for any reason whatsoever, whether TransTrac has a prior notice of it or not;
  • any mis-statement, error or omission in any details disclosed to TransTrac.


If a User claims a refund, before the vendor is settled, TransTrac shall on written request for refund, roll back the transaction to the User after deducting the relevant MDR charges. In case the User claims a refund after the vendor is settled, the User expressly agrees that such transactions cannot be rolled back and hence covenants to resolve this transaction with the Vendor offline and inform TransTrac on such resolution. Neither Acquiring Bank nor TransTrac shall be liable to the User or the Vendor for any such refund in this instance.


The content and functionality on the CredoPay Platform are provided with the understanding that TransTrac is not herein engaged for making payments. TransTrac is an intermediary between banks, Service Providers and Users and merely provides its technology services to make Transactions take place efficiently.

The Service is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to.

The implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

To the extent permitted by law, TransTracwill not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Services.

TransTracmakes no warranty that the functionality of the CredoPay Platform or other TransTrac Services will be uninterrupted or error free, that defects will be corrected or that the Website/application or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

Limitation of Liability and Indemnity

In no event shall TransTrac’s aggregate liability arising out of or related to the terms contained herein, whether in contract, tort or under any other theory of liability, exceed the amount equivalent to 3 months’payment made by you to TransTrac under the Service Agreement entered into by you with TransTrac. Subject to applicable law, TransTrac, its affiliates, employees, directors and suppliers are not liable for any of the following. (a) indirect, special, incidental, punitive or consequential damages; (b) damages relating to failures of telecommunications, the internet, electronic communications, human errors, corruption, security, loss or theft of data, viruses, spyware, loss of business, revenue, profits or investment, or use of software. The above limitations apply even if TransTracand its affiliates and suppliers have been advised of the possibility of such damages.

User shall keep TransTrac safe and harmless and indemnified from and against any and all liability (including but not limited to liabilities, judgments, damages, losses, claims, costs and expenses,) or any other loss that may occur, arising from or relating to any claim, suit or proceeding brought against TransTrac by another User/ Service Provider/ third party for reasons including, but not limited to (i) delivery, non-delivery or delay, deficiency or mistake in respect of the Products purchased sold or services rendered; (ii) a breach, non-performance, non-compliance or inadequate performance by the User of any of the terms, conditions, representations, obligations or warranties made by him; (iii) any acts, errors, misrepresentations, willful misconduct or negligence of the User, or his employees, subcontractors and agents in performance of their obligations under these Terms; (iv) infringement of Intellectual property rights, privacy rights of third parties; (v) third party claims or suits. You agree to reasonably cooperate as requested by TransTrac in the defence of any claims against TransTrac.


If either TransTrac or Service Provider suspects, on reasonable grounds, that a User has committed a breach of the terms contained herein or any other agreement with TransTrac or any act of dishonesty or fraud against TransTrac/ any Service Provider, TransTrac shall be entitled to (a) suspend all payment under the terms contained herein or any other agreement with TransTrac; (b) deactivate/ suspend your User Account and disable your password; and (c) terminate User’s access to the CredoPay Platform or the Services; pending enquiries by TransTrac. User may cancel his User Account at any time by sending TransTrac’s an email to that effect.


User agrees not to disclose or attempt to use or personally benefit from any non-public information that he may learn on the CredoPay Platform or through the Services.

This obligation shall continue until such time as the non-public information has become publicly known through no action of your own. If the User is compelled by order of a court or other governmental or legal body (or have notice that such an order is being sought) to divulge any such non-public information, he agrees to forthwith and diligently notify TransTrac and cooperate fully with TransTrac in protecting such information to the extent possible under applicable law.

TransTrac may access, preserve and disclose any of the user’s information if required to do so by law, or TransTrac believes in good faith that it is reasonably necessary to (i) respond to claims asserted against TransTrac or to comply with legal process, (ii) for fraud prevention, risk assessment, investigation, customer support, product development and de-bugging purposes, or (iii) protect the rights, property or safety of TransTrac, its Users or members of the public. Privacy Policy

User understands that his access to the CredoPay Platform will result in the collection, use and storage of his information which is subject to TransTrac's Privacy Policy. Through his access of the CredoPayPlatform User consents to the collection, use and storage of such information, which will be held by TransTrac and may be processed and stored by Service Providers. For an explanation of TransTrac’s practices and policies related to the collection, use, and storage of Users’ information, please read our Privacy Policy.


  • User shall not (whether on-line or otherwise) describe itself as agent or representative of TransTrac or make any representations to any customer or any third party or give any warranties which may require TransTrac or Service Provider to undertake to or be liable for, whether directly or indirectly, any obligation and/or responsibility to customer or any third party.
  • TransTrac shall not be liable for any breach of these Terms due to any force-majeure event such as act of god, fire, lightning, explosion, flood, inclement weather conditions, power failures, failure in any communication systems, equipment breakdown, strikes, lock-out or any other cause beyond the control of TransTrac.
  • If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms shall continue in effect.
  • TransTrac may assign or transfer its rights and obligations to any other party.
  • In case of any dispute between the parties on the interpretation or implementation of these Terms, the appropriate court in Chennai, Tamil Nadu, India shall have exclusive jurisdiction.
  • No failure or delay by TransTrac in exercising any right, power or privilege shall operate as a waiver thereof.
  • All claims, matters and disputes are subject to the sole and exclusive jurisdiction of the competent courts in Chennai, Tamil Nadu, India.

Annexure A

ANNEXURE A LIST OF PROHIBITED ITEMS: During TransTrac’s Services or while on CredoPay Platform, Users are prohibited from aiding in the sale / exchange of any item present in the below list. This is only an illustrative list and may be amended as and when necessary or as required by law or brought to the notice of TransTrac:

Airline tickets that restrict transfer, other unauthorized ticket sale - Alcohol or tobacco products - Blood, bodily fluids or parts - Bulk email or mailing lists that contain names, addresses, phone numbers, or other personal identifying info Burglary tools, including but not limited to lock-picks or motor vehicle keys - Controlled substances or illegal drugs, substances and items used to manufacture controlled substances and drug paraphernalia -Counterfeit currency, coins and stamps, tickets, as well as equipment designed to make them - Counterfeit, replica, or knock-off brand name goods - Coupons or gift cards that restrict transfer, other unauthorized coupons or gift cards - False identification cards, forged certificates - Fireworks, firearms and explosives - Gambling items, including but not limited to lottery tickets - Material that infringes copyright, including but not limited to software or other unauthorized digital goods sale - Pornography - Pet animal parts, blood, or fluids - Prescription drugs and medical devices, including but not limited to prescription or contact lenses, defibrillators, hypodermic needles or hearing aids - Stolen property, or property with serial number removed or altered.
